These Terms govern your use of Vinette (“the App”), made by BORABADA. By using the App you agree to them.
We grant you a personal, non-transferable, non-exclusive license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
What you make in Vinette is yours. Your writing, your photos and the pages you compose stay yours, and we claim no rights in them.
Kit artwork (stickers, papers, tapes and scenes) is licensed to you for use inside the App, and for personal, non-commercial use of the pages and videos you make with it — keeping, printing and sharing them with friends and family or on social media. You may not extract, resell or redistribute the artwork itself, or use it in products or services of your own.
Vinette Club is an optional subscription that opens every kit. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; renewal is charged within the 24 hours before the period ends. You can manage or cancel your subscription in your Apple Account settings. Without the Club, one short video lets you use 1 sticker from a locked kit, up to 8 videos a day; parts you place stay on your page.
Do not use the App to break the law or to infringe anyone’s rights, and do not attempt to reverse engineer, modify or interfere with the App or its purchase checks.
Your diaries are stored on your device (and in your own iCloud Drive, while iCloud backup is on). You are responsible for keeping copies of anything you cannot afford to lose; Settings › Your pages › Export all pages makes a copy at any time.
The App is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by law, BORABADA is not liable for any indirect, incidental, special or consequential damages, or for lost data, arising from your use of or inability to use the App.
These Terms are between you and BORABADA only, not with Apple. BORABADA, not Apple, is solely responsible for the App and its content.
BORABADA is solely responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
BORABADA is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
BORABADA, not Apple, is responsible for addressing any claims from you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, BORABADA, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with applicable third-party terms of agreement when using the App.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
We may update these Terms. The new version will appear in the App with a new date; continuing to use the App means you accept it.
